Frequently Asked Questions

Everything you need to know about IMEs in New York

An IME is a medical examination ordered by the workers' compensation insurance company to assess your injury and level of disability. A doctor selected by the insurance carrier (not your treating physician) will examine you and provide a report to the Workers' Compensation Board. The IME doctor's findings can significantly impact your benefits, so it's crucial to be prepared and take the examination seriously.
Missing an IME without a valid medical reason can have serious consequences. Your case may be dismissed, your benefits may be suspended, or the judge may decide your case based solely on the IME doctor's findings without hearing your side. In some cases, repeated missed appointments can result in loss of all benefits. Always notify the insurance company immediately if you cannot attend, and provide valid medical documentation if possible.
Most IMEs last between 30 minutes to 1.5 hours, depending on the complexity of your injury. The doctor will take your medical history, perform a physical examination, and may ask you to perform specific movements or exercises to assess your functional capacity. Allow extra time for check-in paperwork and travel.
Most IME doctors will not allow an attorney to be present during the examination. However, you may be able to bring a support person (family member, friend) who can wait in the reception area. Some doctors allow support persons in the exam room, but this varies. Call ahead to ask about the doctor's policy. You are always allowed to take notes and request copies of the exam findings.
Be honest, professional, and respectful. Describe your symptoms and limitations accurately — do not exaggerate or minimize your condition. The IME doctor works for the insurance company, not for you, so they are evaluating your claim objectively. Answer questions directly, avoid arguing, and take the examination seriously. If you don't understand something, ask for clarification.
